Berichten zufolge wurde dem Schauspieler ein Plädoyer-Deal angeboten, „identisch mit dem von Dave Halls angenommenen Vergehensdeal“.
Halls – der zum Zeitpunkt der Dreharbeiten, die zum Tod des Kameramanns führten, erster Regieassistent war Halyna Hutchins – erhielt sechs Monate unbeaufsichtigte Bewährung, 500 US-Dollar, 24 Stunden gemeinnützige Arbeit und einen obligatorischen Waffensicherheitskurs.
Variety berichtet, dass Baldwin dieser Deal am 5. Oktober angeboten wurde und er bis zum 27. Oktober Zeit hatte, sich zu entscheiden … Berichten zufolge stornierte die Staatsanwaltschaft den Deal jedoch am 17. Oktober und teilte Baldwins Team mit, dass sie eine Grand Jury einschalten würden. Es ist unklar, was sich in diesem kurzen Zeitfenster geändert hat.

In seiner Akte wird behauptet, der Staatsanwalt habe es versäumt, die gesamten Tests seiner Schusswaffe durch das FBI vorzulegen, die seiner Meinung nach beweisen würden, dass sie hätte abgefeuert werden können, ohne dass er den Abzug betätigt hätte.

Es wird erwartet, dass Baldwins Fall im Juli vor Gericht kommt und ihm im Falle einer Verurteilung eine Gefängnisstrafe von bis zu 18 Monaten drohen würde. Er hat signalisiert, dass er sich gegen die Anklage wehren wird – und er tut offensichtlich, was er kann, um zu erreichen, dass sie abgewiesen wird, bevor er vor Gericht erscheinen und sich verteidigen muss.
